Australian health workers to close intensive care units in Victoria next week

Members of Australia’s Health Services Union (HSU) will go on strike in Victoria next week in a dispute over stalled wage and career structure negotiations. Over 5000 physiotherapists, speech pathologists and radiation therapists will walk off the job next week, effectively closing the state’s 68 largest health services.

The strike will force the closure of intensive care units and emergency departments across the state.

It is feared the strike could continue into Easter.

National secretary of the HSU, Kathy Jackson said admissions would be crippled, while intensive care patients would have to be evacuated to New South Wales, Tasmania and South Australia as hospitals will not be able to perform tests or administer treatment.

“When an ambulance shows up you can’t admit a patient without an X-ray being available, you can’t intubate them and you can’t operate on them,” she said.

“If something goes wrong in an ICU you need to be able to X-ray, use nuclear medicine or any diagnostic procedure,” said Ms Jackson.

Ms Jackson said the HSU offered arbitration last year, but the state government refused. “They’re not interested in settling disputes, they hope that we are just going to go away.”

“We’re not going away, we’ve gone back and balloted the whole public health workforce in Victoria, those ballots were successful, 97 percent approval rating,” she said.

The HSU is urging the government to commence serious negotiations to resolve the dispute before industrial action commenced.

The government has offered the union a 3.25 per cent pay increase, in line with other public sector workers but the union has demanded more, but stopped short of specifying a figure.

Victorian Premier John Brumby said the claim would be settled according to the government’s wages policy. “The Government is always willing and wanting to sit down and negotiate with the relevant organisations . . . we have a wages policy based around an increase of 3.25 per cent and, above that, productivity offset,” he told parliament.

The union claims it is also arguing against a lack of career structure, which has caused many professionals to leave the health service. Ms Jackson said wages and career structures in Victoria were behind other states.

Victorian Opposition Leader Ted Baillieu said he was not in support of the proposed strike and called on the government to meet with unions. “There could not be a more serious threat to our health system than has been announced today.”

“We now have to do whatever is possible to stop this strike from proceeding,” he said.

The opposition leader will meet with the union at 11:30 AM today.

Victorian Hospitals Industry Association industrial relations services manager Simon Chant said hospitals were looking at the possible impact and warned that patients may have to be evacuated interstate if the strike goes ahead.

Prince closes XVIII Commonwealth Games

Prince Edward formally closed the XVIII Commonwealth Games last night in a spectacular 4 hour ceremony at the Melbourne Cricket Ground.

About 85,000 spectators were in attendance; British Prime Minister Tony Blair and Australian Prime Minister John Howard were also there.

Melbourne 2006 Chairman Ron Walker said that the games were “the greatest coalition of Commonwealth nations ever seen….We have all been united by the moment… …Melbourne, we did it!”

Commonwealth Games Federation chairmen Mike Fennell; named Indian Shooting competitor Samaresh Jung as the winner of the David Dixon Award, for being the Best Athlete of the 18th Commonwealth Games. Jung won five Gold; one silver and one bronze medal in the Games.

Fennell also praised the organisation, crowds, volunteers, transport, and support services as well as the athletic performances and he said that the games had been an “incredible success”.

WWE wrestler John Cena undergoes neck surgery after injury

The Stamford, Connecticut-based company World Wrestling Entertainment issued a press release last night, stating that wrestling performer John Cena is expected to recover from his injuries, after a surgery.

WWE Medical Program head, described in a press release as a “renowned neurosurgeon” Dr. Joseph Maroon performed the operation on Cena, after he sustained injuries during the SummerSlam match on Sunday August 24. He suffered a herniated disc in his neck, in a lost match against a wrestler named Batista.

Just hours after surgery, he visited the locker room of the SmackDown/ECW taping, commenting to the WWE website that: “I feel great. Dr. Maroon is fantastic. He explained every possible procedure he could and could not perform, and the potential risks of all of them. I explained to Dr. Maroon not only my immediate goals, but also my long-term goals. He took them all into consideration and recommended the most commonplace procedure with the least amount of side effects.”

While the option of fusion surgery was chosen previously by other WWE wrestlers (Edge, Steve Austin, Chris Benoit), Maroon removed a fragment from Cena’s spinal cord, which had been blocking a nerve.

The operation lasted 90 minutes; recovery is expected to take three months, instead of a previously suggested 12-14 months.

In his WWE career, Cena is a three-time WWE Champion, a three-time United States Champion, and a two-time World Tag Team Champion. He also won the 2008 Royal Rumble. Before being promoted to the main WWE roster, Cena trained in and wrestled for Ultimate Pro Wrestling and Ohio Valley Wrestling, holding the top titles of both promotions.

FBI arrests nuclear engineer and wife on charges of espionage

In the United States on Saturday, the Federal Bureau of Investigation (FBI) and the Naval Criminal Investigative Service (NCIS) arrested a couple in West Virginia. Court documents released Sunday allege they tried to sell classified data to a foreign nation.

The Maryland couple, former U.S. Navy nuclear engineer Jonathan Toebbe and his wife Diana Toebbe, were both arrested and charged with violating the Atomic Energy Act. Mr. Toebbe worked on naval nuclear reactors and acoustic quieting. Ms. Toebbe is a teacher at the private Key School in their neighborhood in Annapolis, now on indefinite suspension according to the school.

U.S. Attorney General Merrick Garland said in regards to the case, “The complaint charges a plot to transmit information relating to the design of our nuclear submarines to a foreign nation.” The U.S. Department of Justice (DOJ) alleges the couple tried to sell this information to a foreign agent who was actually an FBI undercover agent.

Documents filed in federal court allege Mr. Toebbe arranged to sell restricted information to a foreign power identified only as “COUNTRY1” over several months via encrypted messages, and that he arranged “drops” of these data on SD cards in various locations in exchange for payments in cryptocurrency.

At the first of the drops in West Virginia, the DOJ alleges Mr. Toebbe hid an SD card in a peanut butter sandwich while Ms. Toebbe acted as a lookout. At the second of these in eastern Virginia, the DOJ charges that an SD card was placed in a chewing gum package. Federal officers arrested the couple at the third drop site, in West Virginia, on Saturday.

Both Mr. and Ms. Toebbe are set to appear in federal court tomorrow in Martinsburg, West Virginia.

Gastric bypass surgery performed by remote control

A robotic system at Stanford Medical Center was used to perform a laparoscopic gastric bypass surgery successfully with a theoretically similar rate of complications to that seen in standard operations. However, as there were only 10 people in the experimental group (and another 10 in the control group), this is not a statistically significant sample.

If this surgical procedure is as successful in large-scale studies, it may lead the way for the use of robotic surgery in even more delicate procedures, such as heart surgery. Note that this is not a fully automated system, as a human doctor controls the operation via remote control. Laparoscopic gastric bypass surgery is a treatment for obesity.

There were concerns that doctors, in the future, might only be trained in the remote control procedure. Ronald G. Latimer, M.D., of Santa Barbara, CA, warned “The fact that surgeons may have to open the patient or might actually need to revert to standard laparoscopic techniques demands that this basic training be a requirement before a robot is purchased. Robots do malfunction, so a backup system is imperative. We should not be seduced to buy this instrument to train surgeons if they are not able to do the primary operations themselves.”

There are precedents for just such a problem occurring. A previous “new technology”, the electrocardiogram (ECG), has lead to a lack of basic education on the older technology, the stethoscope. As a result, many heart conditions now go undiagnosed, especially in children and others who rarely undergo an ECG procedure.

The IRS sends the levy notice to the taxpayer s bank, which orders the bank to hold the money in the taxpayer s account(s) for 21 days. The bank is legally obligated to honor the levy. No one can access the funds during this period. The 21-day period provides an opportunity for the taxpayer or his/her representative to contact the IRS and negotiate for a release of the funds controlled by the levy. Once the 21-day period passes, the funds are remitted to the IRS.

Any money deposited after the receipt of the levy is not frozen by the levy. The taxpayer should have full access to the deposited funds. The IRS can only get any subsequent funds deposited by a taxpayer after issuing another bank levy.

Releasing an Income Levy

The IRS will not release an income levy unless a taxpayer resolves his or her back tax liability. The taxpayer can resolve his or her back tax liability through Full Payment, an Offer in Compromise, an Installment Agreement, or through placement in Currently Not Collectible status.

Thus, for the most part, a taxpayer does not need not engage in any special process to release an income levy. However, a taxpayer does need to respond quickly to any IRS requests for documents, so that their case can be resolved before the a levy is imposed.

Releasing a Bank Levy Extreme Financial Hardship

Because a bank levy is a one-time event and the amounts within bank accounts are typically small, the IRS will not always release a bank levy after entering into an Installment Agreement or proving a financial hardship (i.e. Currently Not Collectible status). Instead, the IRS will typically release a bank levy only if the taxpayer is experiencing an extreme financial hardship.

An extreme financial hardship occurs when the funds within the bank account are needed for a specific reason. The reason must relate to allowable expenses, which are those expenses necessary for the health or welfare of the taxpayer, or for the production of income. Usually, if proven, the IRS will release the bank levy up to the amount necessary to pay for the allowable expense.

This means that the IRS COIC Unit has determined that the filed Offer in Compromise has met all procedural requirements.

Unfortunately, releasing a levy through filing an Offer in Compromise is not an exact science. A taxpayer must rely upon the IRS COIC Unit to notify the department that issued the levy (i.e. ACS, Revenue Officer, etc.) that it has received a processable Offer in Compromise. South African apartheid assassin Eugene de Kock granted parole

South African Justice Minister Michael Masutha yesterday announced he is granting parole to Eugene de Kock, an apartheid-era assassin who has spent twenty years in prison.

After South Africa’s first democratic elections in 1994 de Kock was arrested and subsequently detailed his actions to the nation’s Truth and Reconciliation Commission (TRC). As head of a police ‘counter-insurgency’ unit de Kock took responsibility for murdering and torturing dissidents opposed to white-only rule. His methods included bombings, shootings, and stabbings and he operated internationally and at home. His revelations earned him the nickname “Prime Evil”.

The TRC granted de Kock immunity for most crimes in exchange for his testimony. He was charged with remaining offences, not covered due to limits in TRC power, and in 1996 jailed for life for six murders. Additional convictions include kidnap and attempted murder. He received an additional 212-year term for those crimes. The TRC could only grant immunity where the offence was a human rights violation and the offender gave a full confession.

During his TRC testimony de Kock accused police commanders of ordering murders including those of African National Council (ANC) members. In a 2007 prison interview he said FW de Klerk, the last white President, had hands “soaked in blood”. De Klerk denies de Kock’s allegations he ordered individual murders.

In the early nineties de Kock teamed up with anti-ANC party Inkatha to arrange violence within black communities. Internal conflict killed 12,000 in the wake of future President Nelson Mandela’s release. Mandela wrote of fearing “a hidden hand behind the violence[…] attempting to disrupt the negotiations”, by orchestrating the clashes in Natal and Transvaal. He was referring to upcoming elections and a transfer of power away from white rule and apartheid.

Masutha said de Kock was being released “in the interest of reconciliation and nation building”. The date, location, and terms are to remain secret.

Reaction from his victims is varied.

Murder victim Glenack Mama’s widow Sandra welcomed the release. She said to a BBC reporter “I think it will actually close a chapter in our history because we’ve come a long way and I think his release will just once again help with the reconciliation process because there’s still a lot of things that we need to do as a country”. She said “He got the instructions from the top and they [more senior officials] got away with it[…] they’re amongst us today and one man is taking the fall”.

Eddie Makue said to The Associated Press the release stirred up “mixed feelings, which is something we’ve gotten used to as South Africans”. He was a South African Council of Churches employee in 1988 when de Kock bombed their headquarters. Jane Quin said she was “terribly disappointed” and he should never be released. Her sister Jacqui Quin was murdered in Lesotho in 1985 by de Kock.

TRC chairman Archbishop Desmond Tutu said “I pray that those whom he hurt, those from whom he took loved ones, will find the power within them to forgive him.” He said the release would not be universally welcome but is nonetheless “to our collective credit, as people and as a nation.” Tutu called it “an indictment on our government” that apartheid officials who did not co-operate with the TRC had evaded prosecution.

Whilst in prison de Kock has assisted the recovery of his missing victims’ remains. Remorse and his help to the Missing Persons Task Team were cited by Masutha as reasons to release him, which was initially decided against last July. “[H]is key role has been to introduce us to other former security police who can assist with finding others,” said Task Team leader Madeleine Fullard. Fullard said de Kock had also directly assisted in retrieving two bodies. “He certainly feels lives were wasted for no reason”, she added, describing a meeting with him at one ANC victim’s grave. “He seemed to be quite stressed.”

Masutha also announced yesterday the rejection of a parole application by apartheid killer Clive Derby-Lewis, an ex-MP. Derby-Lewis is serving life for murdering popular South African Communist Party leader Chris Hani. Hani also led the ANC’s militant division. His killing in 1993 sparked rioting. Derby-Lewis sought parole because he has lung cancer. Masutha said in rejecting the application that Derby-Lewis was remorseless.

Climate campaigners scale UK Parliament and hang protest banners from the building

Campaigners opposed to the expansion of London Heathrow Airport have today scaled the roof of the U.K. Houses of Parliament and hung protest banners reading ‘BAA HQ’ and ‘No 3rd Runway’ from the building, before and during Prime Minister’s Questions inside the building.

The three men and two women were from climate action group, Plane Stupid. The non-violent direct action comes on the day a government consultation into the Heathrow expansion of a third runway ends.

The protesters made paper aeroplanes out of confidential Whitehall documents that allegedly show collusion between the British Airports Authority (B.A.A.) and the Government department of transport to subvert the public consultation process on the proposed third runway. These documents were obtained from the Department for Transport by Greenpeace under the freedom of information act.

B.A.A. claims a third runway is essential for Britain’s economy, and would reduce congestion at Heathrow, actually cutting emissions, and is necessary to keep up with the booming aviation industry. This would allow the number of flights to increase from 480,000 a year to around 702,000 .

In a statement given by one of the protesters from the roof to the Guardian newspaper:

We’ve come to this symbolic home of democracy to make clear that the consultation process of the third runway at Heathrow has, from the beginning, been a sham.

We’re taking direct action as a last resort because we don’t believe that the consultation has been a democratic process. This is the beginning of a campaign of direct action that will not cease until we feel we’re being listened to and until we’re satisfied that it’s Londoners’ views, rather than B.A.A.’s, that the government paying attention to.

Matthew Knowles from the Society of British Aerospace Companies made a statement to the B.B.C. that: “These stunts are becoming tiresome and do nothing more than peddle inaccurate propaganda.”

The rooftop occupation comes two days after Greenpeace protesters scaled an Airbus A320 which had just touched down at Heathrow from Manchester, and follows a succession of direct action protests in the U.K. in relation to climate change.
