While it’s nice to have rows of flowers in the garden, it’s not so nice to watch flocks of birds destroy your hard work. Without effective bird control, pest birds such as sparrows, swallows, pigeons and crows can and will invade your yard or garden to feed themselves and their young. Blackbirds, starlings, and robins will waste no time yanking out tasty corn seedlings, or chewing into ripening cherries, peaches and blueberries. They also won’t hesitate to crater your lawn while they dig for bugs.

Depending on the weather and the surrounding food supply, birds will have a field day in your garden. In dry years, for example, birds will eat many different fruits and vegetables, including tomatoes and melons. In the absence of bird control, some birds can quickly wipe out an entire berry patch or grain field, aggressively attacking a particular crop they happen to fancy.

And as much as we love to hear them sing, even songbirds will attack your garden at various times of the year. These birds will go after broccoli, corn, green peas, snap peas, apples, apricots, blackberries, blueberries, cherries, currants, grapes, peaches, pears, plums, raspberries and strawberries. You’ll know you have a problem if patches of young seedlings completely disappear, or the tops of your young plants are chewed off, or if you notice bites taken out of the berries as they ripen.

You don’t have to resort to poisons, firearms or deadly traps to keep birds out of your garden. Today, you can avail yourself of many highly effective and humane bird control measures. Some of the more popular approaches are listed below:

Bird Sonic Systems

These handy devices strike fear in birds’ hearts but they won’t harm a feather on their little bodies. Unlike “loud bang” noisemakers that only scare birds temporarily and do nothing to prevent them from returning, Sonic Bird Deterrents offer an effective solution. They broadcast predator and distress calls that make pest birds feel threatened. They recreate the sounds of Peregrine falcons defending their territory (very scary if you’re a pigeon); or they imitate predator hawks screeching and gulls under attack (equally frightening if you’re a starling or seagull). These sounds persuade birds to leave post haste. The best sonic bird deterrents can be programmed to emit distress and predator calls day and night. It is suggested to continually alter the frequency, timing and intensity of their sounds, which prevents birds from becoming too accustomed to the threat.

Hawk Decoys

No bird likes to eat while a predator is watching. Fortunately, most birds have a natural fear of hawks, which hunt during the day–the time most birds like to feed. Hawk Decoys work quite well in gardens. They’re easy to mount and display, and the better designed ones look very real. Made of heavy duty plastic, quality hawk decoys are weather- and water-resistant. They can be hung from rafters or overhangs, or simply placed anywhere your garden is being threatened by pest birds. Some decoys are hollow, so you can fill them with sand for added stability.

Bird Netting

If they can’t get at your garden, they can’t eat or destroy it. Bird netting uses the exclusion principle of bird control to humanely deter birds from your garden. To stop a full variety of birds, bird netting now comes in many types and mesh sizes.

One type of bird netting that’s ideal for protecting gardens is Ultra Net. This low-profile netting is designed to keep pest birds away from fruit trees, bushes and gardens. The lightweight netting is constructed of tough, U.V.-protected polypropylene, yet it blends in aesthetically with its surroundings. Ultra Net comes in 3/4-, 1/2-, and 1/4-inch mesh sizes and is available in bulk rolls or pieces to suit a specific area requirement. The netting has been widely used to stop pigeons, swallows, crows, gulls and sparrows from invading and destroying gardens and trees.

Setting up an Ultra Net barrier is quite simple. If you want to protect your vegetable gardens, wrap individual plants in netting or suspend the netting around the entire garden area to lock out pest birds. For blueberry bushes and grape vines, suspend the netting about six inches over the bush or vine. This will prevent pest birds from perching on the net and eating fruit through the mesh. Another way to suspend Ultra Net is to attach it to a series of poles surrounding the perimeter. To protect fruit trees, cut the netting one-foot wider than the diameter of the tree’s crown and secure the netting with twine, zip ties or hog rings.

Imprisoned Haitian priest may need US doctors

Supporters of jailed priest Jean-Juste say that he needs medical treatment in the United States. His attourney, Bill Quigley, told reporters that the priest, who was considered a potential presidential candidate before his arrest and long detainment, may have cancer and should be released so that he can seek medical attention in the United States. A doctor, Dr. John Carroll, who examined Jean-Juste said that an abnormal white blood cell count, as well as swelling in his neck and under his arms could be early signs of cancer. The government of interim President Alenxandre said that their doctors have examined the priest as well and said no signs of cancer exist.

Jean-Juste has been in jail since July when he was arrested at a funeral of a popular Haitian journalist and poet. He was originally detained for questioning related to the murder but also allegations of illegal weapons possessions have been brought up. He’s yet to be charged in any crimes. The doctor who made the claim of possible cancer is a supporter of Jean-Juste and some might think that this is an exaggeration to allow Jean-Juste out of Haiti to plan his political future.

Buffalo, New York —A copy has been obtained of the lawsuit filed against the City of Buffalo for allegedly fast-tracking a seven million dollar hotel proposal.

The Elmwood Village Hotel is a 72-room, seven-million-dollar hotel proposed by Savarino Construction Services Corporation and designed by architect Karl Frizlen of the Frizlen Group. Its construction would require the demolition of at least five buildings, currently at 1109-1121 Elmwood, which house several shops and residents. Although the properties are “under contract,” it is still not known whether Savarino Construction actually owns the buildings. It is believed that Hans Mobius, a resident of Clarence, New York and former Buffalo mayoral candidate, is still the owner. The hotel is expected to be a franchise of the Wyndham Hotels group.

According to official court documents, there are more defendants than previously thought. Documents state that not only Buffalo’s Common Council and Planning Board are named in the lawsuit, but also the Mayor of Buffalo, Byron W. Brown, Savarino Construction Services Corporation, Hans J. Mobius and his son Hans S. Mobius owners of the properties at stake, Pano Georgiadis, owner of Pano’s Restaurant on Elmwood, and Cendant Corporation, the parent company of Wyndham Hotels are also named in the suit.

According to the lawsuit, during the length of the trial, Savarino Construction along with their employees, Hans Mobius and his son are not allowed to make any alterations or “engage in the physical alteration” of any of the said properties, 1109-1121 Elmwood and 9999 Forest. The suit also states that the owner of 605 Forest, Pano Georgiadis is also to follow the same rule.

The suit also states that Hans Mobius, his son and employees or “agents” are not allowed to “take any step, lawful or otherwise, to terminate [the] petitioners, Nancy Pollina and Patricia Morris,” owners of Don Apparel at 1119 Elmwood “tenancies.” Although the business is owned by Pollina and Morris, they are without a lease.

Within the suit it states that the rezoning of the properties 1119-1121 Elmwood and 605 Forest, by the Common Council, from a ‘R3’ Dwelling District to a C2 commercial zone “constitutes as impermissible ‘spot-zoning'” and is “not in accord with a well-considered plan for the development of the community and is null and void.” According to the suit the courts of New York have defined spot-zoning as “the process of singling out a small parcel of land for a use classification totally different from that of the surrounding area, for the benefit of the owner of such properties and to the detriment of other owners.” The suit also states that the proposed site for the hotel is different from the surrounding properties because none of the zoning classifications, ‘EB’ [Elmwood Avenue Business District], ‘R3’ [Dwelling District], ‘R1’ [One Family District] and ‘R2’ [Dwelling District], permit the construction and operation of a hotel.

It is alleged that Savarino Construction “failed to utilize forms obtainable from the city clerks office, failed to include an accurate map or survey showing the location of all buildings and structures and failed to include the names and addresses of each of the owners of the properties to be rezoned.”

It is also believed that recommendation in regards to [hotel] compatibility, different land uses, traffic studies, community character, population density, relations between other residents and business owners, public convenience, governmental efficiency, and achieving and maintaining a satisfied community, were to be sent to Erie County’s Planning agency and was to refer Savarino’s rezoning application and site plan to the agency, however; the lawsuit alleges that although a referral was given to Savarino, it “does not appear that the ‘full statement of such proposed action’ was forwarded to the County [Agency].”

The suit also alleges that the Common Council “failed to wait the ‘statutorily-mandated’ 30-days after the County’s Planning Agency’s receipt” of recommendations from the Council. The County’s Planning Agency replied to the recommendations, however; the Agency replied on March 27, 2006, just six days after the Council made its recommendations, falling well short of the “statutorily-mandated” thirty days. The Agency’s reply however, did not support or oppose the recommendations or hotel proposal.

Public hearings are required to be registered by the City clerk to the City Planning Board, and according to the suit, “no record” of the Public hearing on March 7, presenting the initial proposal to the public, was made within the City’s Clerk office or Planning Board.

The suit also alleges that the Common council and Planning Board also violated the State’s Environmental Quality Review Act or SEQRA and the City’s Environmental Review Ordinance by allowing the Planning Board to be the “lead agency” instead of the Common Council. A lead agency is an involved agency principally responsible for undertaking or approving an action and therefore responsible for determining whether an Environmental Impact Statement or EIS is needed, according to the SEQRA regulations. The suit also states that the hotel proposal “constitutes an action under the SEQRA” because the project could “affect the environment by changing the use, appearance or condition of any natural resource or structure that requires one or more approvals from an agency or agencies” and that the Common Council and Planning Board are “obliged to comply with both the letter [recommendations] and spirit of the SEQRA review process” which include identifying the areas of environmental concerns and taking a “hard look” at them. The suit also claims that the Common Council has the “sole authority to grant Savarino Construction’s rezoning request” and “to approve the special development plan,” but it also claims that the Planning Board is “an involved agency” but that it is “clearly subordinate to that of the Common Council” therefore the decision made by both the Council and Planning Board to allow the Planning Board to be the ‘lead agency,’ is in “violation” of the State’s SEQRA and “renders all determinations” made by the Planning Board and Common Council on March 14, 21, and 28, 2006, “void and unauthorized.” It goes on to say that the Council “proceeded without or in excess of their jurisdiction, and/or made a determination in violation of lawful procedure, affected by an error of law, and/or in an arbitrary and capricious manner.” It also states that unless the requirements of the SEQRA are met, then the petitioners have the right to “seek a temporary restraining order” from the Court if circumstances require it.

The suit also states that a failure to grant a preliminary injunction, through the courts, will result in “irreparable injury” to the petitioners and that the Council and Planing Board have failed to comply with the requirements of the SEQRA and have violated several other state laws and city codes.

So far, Savarino Construction has not responded to any calls or e-mails. District councilman Joseph Golombek also has not responded. Georgiadias was unavailable for comment.

A preliminary hearing is scheduled to take place at 9:30 a.m. on June 8, 2006 in the Supreme Court building at 50 Delaware Avenue in Buffalo, on the 8th floor, part 31.

The New Zealand Police has reported that a three-year-old boy choked to death on Saturday afternoon, due to what they believe was a piece of candy at his birthday party.

The parents did call New Zealand’s emergency number, 1-1-1, after their son alerted his parents to the fact that he was choking. The paramedics were unable to revive the Napier boy when they arrived at the scene.

The case has been referred to a coroner.

Relatively unknown golfer Zach Johnson won the 71st Masters Tournament in Augusta, Georgia. Johnson shot 3-under-par 69 in Sunday’s fourth round, to win by 2 strokes over Tiger Woods, Retief Goosen, and Rory Sabbattini.

Johnson won a purse worth US$1,305,000 and a lifetime qualification to the Masters Tournament, held annually at the Augusta National Golf Club.

A couple living in New York City have decided to take a taxi all the way to Arizona. Betty and Bob Matas are retiring and leaving the city for good. What started as joke, has become reality, in part to spare their cats from traveling in a jetliner cargo-hold. They have negotiated a US$3,000 flat fee instead of the metered rate, which was estimated at US$5,000.

A vocational nurse working for Dr. John Capriotti, a plastic surgeon, was accused of setting the fire that wounded several and killed three people in Houston, Texas on March 28. She was allegedly trying to cover up the fact that she hadn’t completed the paperwork for an upcoming audit.

The fire began in Dr. Capriotti’s office on the fifth floor and quickly spread to the sixth. Arson investigators from the Houston Fire Department, the FBI and the Federal Bureau of Alcohol, Tobacco, Firearms and Explosives had been working to determine the source of the fire.

Iran announced that it has started industrial scale production of nuclear fuel involving hundreds of centrifuges. The announcement comes as President Mahmoud Ahmadinejad reasserts his nation’s nuclear rights in the face of two rounds of sanctions by the UN Security Council, which is seeking a halt to such work.

The United States denounced the declaration, saying it showed Iran was defying the international community.

“We’re only two days in and we’re already fucking tired,” says Sune Rose Wagner to David Shankbone as he walks into the dressing room at the Bowery Ballroom. Wagner and Sharin Foo comprise the Raveonettes, a group made for “nostalgists who long for Everly Brothers 45’s and diner jukeboxes, the Raveonettes tweak “American Graffiti”-era rock with fuzzed-out surf-guitar riffs,” said The New York Times. They recently left Columbia and signed with Fierce Panda because they felt constrained by their Columbia contract: “The major label system sometimes doesn’t allow for outside “help” to get involved, meaning that we don’t get to choose who we wanna work with. That can be a pretty terrible thing and bad things will surely come of it,” said the band on their MySpace site. Originally from Denmark, both musicians live in the United States now.

Their first EP, Chain Gang of Love, was a critical and commercial success. “Few albums provoke such amazing imagery,” said the BBC. “Pretty in Black is virtually fuzz-free,” said Rolling Stone of their next album, “highlighting the exquisite detail in the Raveonettes’ gift for pastiche: the prowling, garage-surf guitars in Love in a Trashcan; the ghost dance of Red Tan, wrapped in Phil Spector-style sleigh bells.” Of their current album, Lust Lust Lust, set to be released on November 5th (although Amazon says March 4, 2008), Sune told NME that, “There are a lot of songs that deal with desire, restlessness and the tough choices you have to make sometimes.” Fans can hear some of the new material at MySpace.com/TheRaveonettes.

Previously this card was known as \’blue card\’. In general OHS induction for construction training teaches people the knowledge and Queensland residents or interstate people who will be working in Queensland Construction site should have the QLD White Card.

The Statement of Attainment is used as evidence supporting the fact that the White Card course has been completed. It is used to gain access to construction sites. The

course is targeted at all workers involved in construction work.Students who want to pursue this course will learn the basic principles of health and safety in the construction industry as well as they will also be taught about the precautions to prevent workplace injury and illness, how to manage workplace injury and workers compensation.

White card Australia is a national code of conduct for the construction Industry, which was declared by Safe Work Australia. This is a regular and consistent delivery of induction training that is given to workers throughout Australia. Since it have a National Code of Conduct it make sure that workers who are involved with construction industry are recognized and they must complete the induction training course. Training is provided by RTOs* within the Vocational Education and Training. This White Card Course will change a range of state systems operating other coloured cards such as Blue, Green, Red and regulatory bodies. The transformation of this to the National White Card will take place in each state at different times.

The unit of aptitude is called CPCCOHS1001 A Work safely in the construction industry. This has been created to match the requirements of the National Code of Practice for Induction for Construction Work. After successfully completing this unit of aptitude a student will receive a statement of attainment and the White Card License. Most states in present have rules and regulations in place, which mandates completion of a general safety induction course before anyone can join the construction industry. As such, all the states have developed its own course to meet that obligation.

However, from 1 July 2009 most states have amended their rules & regulations to make sure that only CPCCOHS1001A meet the regulatory obligations. It should be noted by the RTOs that a number of jurisdictions are coming up with a plan to limit training to face-to-face only. The White Card Queensland course is targeted at all workers engaged in construction work, including: self-employed persons, labourers, traders, supervisors and project managers.

Regulators in each state have different requisites, which RTOs should have to match before they can teach this course CPCCOHS1001A Work safely to the employees who are looking forward to work in construction industry.

For example one can only pursue the White Card Australia Qualification online if he/she are a resident of Queensland or Western Australia. Some RTOs have the authorization to deliver the online course in Tasmania and Northern Territory.

Church of Scientology does not see humor in website dedicated to Tom Cruise

The Church of Scientology has threatened legal action in order to take over ownership of the domain name of a web site which links to the odd behaviour of one of the world’s most famous scientologists: Tom Cruise.

http://ScienTOMogy.info has apparently received a fax and at least 6 emails in the span of 2 days from Scientology lawyer Ava Paquette of Moxon & Kobrin threatening a lawsuit of up to $100,000 if the domain name ownership is not transferred. This type of letter is often called a cease and desist letter.

The owners of scienTOMogy.info have posted the complaints and their replies, saying that the site simply expresses opinion, does not make any claims, and clearly states that it has no connection to the Church of Scientology. “The site was put up as a single source to view all the recent hype Tom has made about the church – it does nothing but show Tom, so we are at a loss as to why the church is acting so rashly.”

The Church of Scientology is notorious for pursing legal action against its critics, under the name of the “Religious Technology Center” (RTC). It previously made headlines when it used the US’s Digital Millennium Copyright Act to remove xenu.net, a site critical of Scientology, from Google’s listings.

4 local government areas in New South Wales, Australia locked down after COVID-19 case

The local government areas of Ballina Shire, Byron Shire, the City of Lismore, and Richmond Valley in New South Wales, Australia were placed under stay-at-home restrictions effective at 6PM local time on Sunday, with residents only allowed to leave their homes for essential reasons that include grocery and other essential shopping, medical appointments, vaccinations, and caring duties. The order is to remain effective until 12:01AM on August 17th.

This follows the announcement of a COVID-19 case in the region – a man who had travelled to the Byron Shire from Sydney, also under such restrictions. New South Wales chief health officer Kerry Chant said the man, currently under treatment at Lismore Base Hospital, was “infectious in the community for a while”, and had “symptoms for several days”.

Mayor of Byron Shire Michael Lyon told residents “if anyone is not feeling well please, please go and get tested”, stating while information about the COVID-19 case is emerging, “…people should be making sure they are checking in with QR codes whenever they go into a shop or business, wearing a face mask and social distancing.” New South Wales recorded 283 cases of the coronavirus on Monday.
