Evangelist Kent Hovind’s tax trial begins

Evangelist Kent Hovind and his wife, Jo, are trying to convince a federal jury that their money from video and amusement park admission sales belong to God and cannot be taxed. The trial began at United States District Court for the Northern District of Florida on Tuesday October 18, 2006 after twelve jury members and two alternates were selected to decide on the 58 federal courts against Hovind and his wife. The trial was expected to take at least two weeks to complete with the prosecution hoping to rest its case Tuesday, but a defense attorney became ill and the Judge delayed the trial until October 30th.

Hovind is a Young Earth creationist who does many speaking engagements and debates. He also sells videos giving a pro-creationism perspective, which he receives income for. Hovind, who calls himself “Dr. Dino”, received a Ph.D in “Christian education” from the unaccredited correspondence school Patriot Bible University in 1991.

Prosecutor Michelle Heldmeyer said from 1999 to March 2004, the Hovinds took in more than $5 million. Heldmeyer charged Hovind on 12 counts for failing to pay about $470,000 in federal income, Social Security and Medicare taxes for his ministry employees between March 31, 2001, and Jan. 31, 2004. Counts 13 through 57 include Hovind’s wife for making 45 transactions in a little more than a year, sometimes taking out as much as $9,500 at a time. Banks are required to report cash withdrawals that exceed $10,000.

In count 58 against Kent includes filing a frivolous lawsuit against the IRS, demanding damages for criminal trespass, filing an injunction against an IRS agent, making threats against investigators and those cooperating with the investigation, and filing false complaints against the IRS for false arrest, excessive use of force and theft.

In July with his attorney, Public Defender Kafahni Nkrumah, Hovind stated that he did not recognize the government’s right to try him on tax-fraud charges.

This is not the first time Hovind has found himself in legal trouble. In 2002 he refused to get a $50.00 building permit for his Dinosaur Adventure Land, and after three years of legal battles the court ruled that he get a permit or the building would be razed. More directly, M.C. Powe, an IRS officer who investigates people who have unpaid tax returns or unpaid tax liabilities, testified at Hovind’s current trial on October, 19, 2006 that she first attempted to collect taxes from the Hovinds in 1996. She noted Hovind tried several “bullying tactics” that included suing her at least three times. These resulted in each case being thrown out.

Assistant U.S. Attorney Benjamin Beard handled Hovind’s bankruptcy in 1996 testified on Wednesday that in 1996 after Hovind’s vehicles were seized by the IRS, he filed under the Chapter 13 “wage-earner plan,” available only to those who have a regular source of income. However, Brian Popp, Hovind’s employee for at least eight years, said he considered himself a minister at the time of his employment, but said Hovind’s ministry isn’t a church. Popp also testified that Hovind knew about the bank’s requirement to report transactions over $10,000 and said it was “not safe to carry large sums of cash.”

Further, Popp said Hovind told his workers not to accept mail addressed to “KENT HOVIND” because Hovind told the workers the government created a corporation in his “all-caps name” and if the mail was accepted, Hovind claimed, it would be accepting the responsibilities associated with that corporation.

Diane P. Cooksey, served as a sales representative for the ministry from January 2003 to June 2005, and said Hovind expected to pay her own taxes. Cooksey said, “He explained what his belief was, right up front in the interview, that I would pay my own taxes.” As told’s worker, she received $10 an hour in a weekly paycheck, punched a time clock, was given 10 paid vacation days a year, and considered herself an employee, not a missionary as a few others called themselves.

The IRS raided Hovind’s Dinosaur Adventure Land in April 2004, after which Hovind required his employees to sign nondisclosure agreements. “I was uncomfortable signing it, I guess, because of not having a full understanding,” Cooksey said.

Rebekah Horton, vice president of the unaccredited Pensacola Christian College, took the stand on the second day of the trial and testified that “We know the Scriptures do not promote (tax evasion)”. “It’s against Scripture teaching.”

Horton was given a videotape in the mid 1990s from a woman who worked for Hovind. The video contained “another evangelist advocating tax evasion,” Horton explained. The woman who gave the tape to Horton claimed Hovind’s philosophy as “You were giving a gift with your work, and they were giving a gift back to you.”

Pensacola Christian College decided to disallow its students from working with Hovind’s Creation Science Evangelism and reported Hovind’s scheme to the IRS.

On Friday, attorney David Charles Gibbs testified that Hovind claimed he had no obligation to pay employee income taxes and explained with “a great deal of bravado” how he had “beat the tax system.” Gibbs is an attorney with the Gibbs Law Firm, also is affiliated with the Christian Law Association, a nonprofit organization founded by his father that offers free legal help to churches nationwide in a suburb of St. Petersburg, Florida. Gibbs attended the Marcus Pointe Baptist Church when Hovind was a guest speaker at the church on October 17, 2004. Hovind invited Gibbs and others to Hovind’s home for pizza and soda.

Gibbs testified they talked for many hours, and Hovind “tried to stress to me that he was like the pope and this was like the Vatican.” Also Gibbs explained Hovind also told him he preferred to deal in cash because “dealing with cash there is no way to trace it, so it wasn’t taxable.”

Later on Friday, Special IRS Agent Scott Schneider took up the remainder of the day and is expected to resume Monday. Schneider told the jury his investigation revealed that Hovind “hadn’t filed tax returns ever, to my knowledge.”

Hovind tried suing the IRS and Schneider several times to avoid providing information required by the IRS. Each filing was thrown out by the judges.

Schneider’s discussed documents seized during the 2004 raid of Hovind’s property. These documents, Schneider explained, indicated Hovind ran his ministry as a business with “meticulous” payroll documents and a time clock employees had to punch in and out.

In the raid cash was found “all over the place.” Ultimately, $42,000 in cash was seized along with half-dozen guns (including a SKS semiautomatic) at the Hovinds’ home.

The Pensacola News Journal noted that “in one memo, Jo Hovind informed her daughter, who works at the park, that her pay would be docked $10 for talking too long on the telephone when she should have been working.”

Irish Senator Kieran Phelan dies at age 60

Irish Senator Kieran Phelan has died suddenly at the age of 60. Phelan died after falling ill in his hotel in Dublin this morning, shortly before a meeting due to be held by the Seanad.

Phelan sat on the Industrial and Commercial Panel and had been a Senator since 2002. He was also a Laois County councillor and was elected council chairman in 1998. He was a member of the Fianna Fáil party.

Taoiseach Brain Cowen released a statement on the death of Senator Phelan. “Kieran is a well known, much admired and greatly respected member of Seanad Éireann. He is a constituency colleague of mine and a lifelong friend. I will miss him deeply,” he said.

As a mark of respect, Leader of the House Donie Cassidy proposed that the house be adjourned until June 1st.

Docudays UA eleventh edition opens

The Eleventh International Human Rights Documentary Film Festival opened Friday in the Red Hall of the Kyiv Cinema House, in Kyiv, Ukraine. The festival spans eight days, ending on March 28.

Competition programs are divided into DOCU/Right, DOCU/Life, and DOCU/Short. Each program has its own jury that consists of famous human rights activists, film producers, directors, critics, writers etc. Among them are Andrzej Poczobut (Belorus), Natalka Zubar (Ukraine), Oksana Sarkisova (Hungary), Boris Miti? (Serbia), Chris McDonald (Canada), Simone Baumann (Germany), Andrei Zagdansky (Ukraine), Victoria Belopolskaya (Russia), and Stephanie Lamorre (France). Students’ Jury and Audience Awards are also to be given. The Organizing Committee is to award an Andriy Matrosov Award.

Non-competition programs are divided into areas titles Ideorruption, DOCU/Ukraine, DOCU/Riot, DOCU/Art, DOCU/Best, HOT DOCS presents, Artdocfest presents, and Andrei Zagdansky Retrospective.

The best films are also to be shown during Docudays UA Travelling Festival.

The opening film was called Euromaidan: Rough Cut. It was a combination of shots of different film directors that have been filming the protests in Ukraine during these past four months. Organizers and creators explained, “This is what it is. It is actually a ‘rough cut’. It is a collection of different episodes”.

The festival was first held in 2003, called at that time Docudays on Human Rights. In 2006 the festival was accepted as part of the international Human Rights Film Network at the International Documentary Film Festival Amsterdam. It is usually held during the last week of March.

Wikinews interviews Australian Paralympic assistant coach David Gould

Wikinews caught up with Australian wheelchair basketball coach David Gould in Canberra, where the Australia women’s national wheelchair basketball team — the Gliders — were having a training camp.

Gould told Wikinews he retired from playing after the 2002 World Championships. He said he began coaching able bodied basketball at schools and clubs in South Australia. He was awarded a scholarship by Basketball Australia and the Australian Sports Commission, and became assistant coach of the Under 23 Men’s team in November 2011. He is now national wheelchair skills coach, assistant coach of the men’s and women’s national teams, and coach of the Under 23 Men’s and Under 25 Women’s teams.

He noted the Gliders have another training camp coming up in Brisbane in August. This is to be an open development camp any player can attend. Twelve players are to be selected for the Asia Oceania Zone (AOZ) Wheelchair Basketball Championships in Bangkok in November. The top three teams then qualify for the World Championships, to be held in Canada next year.

He is acutely aware the Gliders have never won a World Championship or a Paralympics. But he has won a gold medal, with the men’s team, the Rollers, in Atlanta in 1996. “We went on a tour of the United States beforehand”, he recalled. Facing the United States in the United States was daunting. There was a huge crowd. So how did they do it? “We had confidence in ourselves, and stuck to our plan,” he recalled.

This, he said, is what he and Glider’s head coach Tom Kyle are trying to teach the Gliders. To believe in the process. They take them out of their comfort zone, show them the right techniques, the right way to do things. The idea is to get the principles right.

Gould told Wikinews they have to look not just to the 2016 Summer Paralympics in Rio in 2016, but further ahead to 2020. They have to recruit new players and develop them. He said he took a Gliders team to the Osaka Cup with only four members of the 2012 team, in order to give members of the development team experience with international competition. He set up a mentor system whereby the six newcomers were each paired with one of the old hands.

Wikinews was shown how the games are videoed and critiqued by the coaches. Special software allows the videos to be edited. Effects such as circling players can be added, along with captions and audio from the coaches. The edited video can then be downloaded by the players. Gould said there is a weekly video conference with the players.

He considered video of other teams is an important training tool. He noted the Gliders had to play Brazil in the first match of the Paralympics in London, which was very tough, because so little was known about them. As it turned out, Brazil has a great program, and he thinks it could be a contender in front of a home crowd in Rio in 2016.

Wikinews noted one of the Gliders, Amber Merritt, had her arm in a sling. Gould said her arm had been scanned, and the doctors will make their evaluation. Like most elite athletes, he knows about injury first hand. He told Wikinews he had injured his shoulder during the 2000 Olympics, and had to have it operated on afterwards. He said he did not want players playing injured, and sometimes it was better just to lose a week if you have the flu. He expected his players to be honest and up front with themselves, their coaches and their team. “We need everyone on the same page”, he told Wikinews.

Gould told Wikinews the Asia Oceania Zone championships will feature Australia, Japan, China, Thailand, South Korea, and perhaps Hong Kong. The venue in Bangkok is well known to him, as the U23 Men’s team have already played there. His plan is to arrive early, to allow the players to acclimatise to the high humidity and the food. Some of the U23 men got sick. He does not expect difficulty qualifying, but it is “one of the I’s that have to be dotted and T’s that have to be crossed.”

He said Australians intend to apply full pressure, but one of their objectives is also to help the competition. One of the problems in Australia is that it takes a long time to go anywhere, he told Wikinews. By building up the teams in the Asia Oceania Zone, he hopes Australian teams will not have to travel so much or so far to meet first class competition.

Cleveland, Ohio clinic performs US’s first face transplant

A team of eight transplant surgeons in Cleveland Clinic in Ohio, USA, led by reconstructive surgeon Dr. Maria Siemionow, age 58, have successfully performed the first almost total face transplant in the US, and the fourth globally, on a woman so horribly disfigured due to trauma, that cost her an eye. Two weeks ago Dr. Siemionow, in a 23-hour marathon surgery, replaced 80 percent of her face, by transplanting or grafting bone, nerve, blood vessels, muscles and skin harvested from a female donor’s cadaver.

The Clinic surgeons, in Wednesday’s news conference, described the details of the transplant but upon request, the team did not publish her name, age and cause of injury nor the donor’s identity. The patient’s family desired the reason for her transplant to remain confidential. The Los Angeles Times reported that the patient “had no upper jaw, nose, cheeks or lower eyelids and was unable to eat, talk, smile, smell or breathe on her own.” The clinic’s dermatology and plastic surgery chair, Francis Papay, described the nine hours phase of the procedure: “We transferred the skin, all the facial muscles in the upper face and mid-face, the upper lip, all of the nose, most of the sinuses around the nose, the upper jaw including the teeth, the facial nerve.” Thereafter, another team spent three hours sewing the woman’s blood vessels to that of the donor’s face to restore blood circulation, making the graft a success.

The New York Times reported that “three partial face transplants have been performed since 2005, two in France and one in China, all using facial tissue from a dead donor with permission from their families.” “Only the forehead, upper eyelids, lower lip, lower teeth and jaw are hers, the rest of her face comes from a cadaver; she could not eat on her own or breathe without a hole in her windpipe. About 77 square inches of tissue were transplanted from the donor,” it further described the details of the medical marvel. Leading bioethicist Arthur Caplan of the University of Pennsylvania withheld judgment on the Cleveland transplant amid grave concerns on the post-operation results. “The biggest ethical problem is dealing with failure — if your face rejects. It would be a living hell. If your face is falling off and you can’t eat and you can’t breathe and you’re suffering in a terrible manner that can’t be reversed, you need to put on the table assistance in dying. There are patients who can benefit tremendously from this. It’s great that it happened,” he said.

Scientists elsewhere have performed scalp and ear transplants. However, the claim is the first for a mouth and nose transplant. Experts say the mouth and nose are the most difficult parts of the face to transplant.

In 2004, the same Cleveland Clinic, became the first institution to approve this surgery and test it on cadavers. In October 2006, surgeon Peter Butler at London‘s Royal Free Hospital in the UK was given permission by the NHS ethics board to carry out a full face transplant. His team will select four adult patients (children cannot be selected due to concerns over consent), with operations being carried out at six month intervals. In March 2008, the treatment of 30-year-old neurofibromatosis victim Pascal Coler of France ended after having received what his doctors call the worlds first successful full face transplant.

Ethical concerns, psychological impact, problems relating to immunosuppression and consequences of technical failure have prevented teams from performing face transplant operations in the past, even though it has been technically possible to carry out such procedures for years.

Mr Iain Hutchison, of Barts and the London Hospital, warned of several problems with face transplants, such as blood vessels in the donated tissue clotting and immunosuppressants failing or increasing the patient’s risk of cancer. He also pointed out ethical issues with the fact that the procedure requires a “beating heart donor”. The transplant is carried out while the donor is brain dead, but still alive by use of a ventilator.

According to Stephen Wigmore, chair of British Transplantation Society’s ethics committee, it is unknown to what extent facial expressions will function in the long term. He said that it is not certain whether a patient could be left worse off in the case of a face transplant failing.

Mr Michael Earley, a member of the Royal College of Surgeon‘s facial transplantation working party, commented that if successful, the transplant would be “a major breakthrough in facial reconstruction” and “a major step forward for the facially disfigured.”

In response to the medical breakthrough, a British medical group led by Royal Free Hospital’s lead surgeon Dr Peter Butler, said they will finish the world’s first full face transplant within a year. “We hope to make an announcement about a full-face operation in the next 12 months. This latest operation shows how facial transplantation can help a particular group of the most severely facially injured people. These are people who would otherwise live a terrible twilight life, shut away from public gaze,” he said.

English court jails policeman over insurance fraud

A court in England, UK has jailed a policeman for ten months after he was convicted of defrauding his car insurance company.

Police Constable Simon Hood, 43, arranged for a friend who dealt in scrap metal to dispose of his Audi TT, then claimed it had been stolen.

Hood had been disappointed with the car’s value when he tried to sell it two years after its purchase in 2008. He arranged for friend Peter Marsh, 41, to drive the vehicle to his scrapyard in Great Yarmouth, Norfolk. Marsh then dismantled the vehicle with the intent of disposing of it, but parts were later found wrapped in bubblewrap at Ace Tyre and Exhaust Centre.

Marsh picked up the TT from outside nearby Gorleston police station. Records show mobile phone conversations between the conspirators that day in March, both before and after the vehicle was reported stolen. The pair denied wrongdoing but were convicted of conspiring to commit insurance fraud after trial.

The fraud was uncovered after Hood told former girlfriend Suzanne Coates of the scheme. It was alleged before Norwich Crown Court that he had confessed to her in an effort to resume their relationship. Coates said that after the pseudotheft, Hood told her “he didn’t want to look for it. He said it would be like looking for a needle in a haystack, which I thought was a bit strange.”

Shortly afterwards Hood suggested they should become a couple once more, she said; she challenged his version of events regarding the car: “He said he did it but I couldn’t tell anyone. He said he did it with Peter. Peter had a key and took the car away and it was going to be taken to bits and got rid of so it was never found.”

Hood was defended by Michael Clare and Marsh by Richard Potts. Both lawyers told the court that their clients had already suffered as a result of the action in mitigation before sentencing. Clare said Hood had resigned from the police after fifteen years of otherwise good service and risked losing his pension. “It is not a case where his position as a police officer was used in order to facilitate the fraud,” he pointed out. “His career is in ruins.” Hood is now pursuing a career in plumbing.

Potts defended Marsh by saying that he, too, had already suffered from his actions. His own insurers are refusing to renew their contract with him when it expires and his bank withdrew its overdraft facility. His business employs 21 people and Potts cited Marsh’s sponsorship of Great Yarmouth In Bloom as amongst evidence he supported his local community.

Judge Alasdair Darroch told Marsh that he did accept the man was attempting to help his friend. He sentenced Marsh to six months imprisonment, suspended for two years and ordered to carry out 250 hours of community service. He was more critical of Hood:

“As a police officer you know the highest possible standards are demanded by the public. You have let down the force. You knew throughout your career that policemen that get involved in serious dishonesty get sent to prison.”

A Dental Hygienist is one of the fastest growing careers today because it not only pays well, but it also allows for a flexible schedule. With an associates degree, you can launch your career and work in an office. However, if you see yourself working in public programs, such as school, you will need to have a bachelors degree.

The skills for this career will vary; depending on where you live and the amount of training you have. While most people interested in this career will go to college, others receive on-the-job training instead. You will need to possess people skills since you will be dealing with others frequently. Some people do not mind the dentist office while others are scared and afraid; children and adults. You need to be able to talk to them and calm them down so their visit is not dreadful, but caring and compassionate.

There is a difference between a Dental Assistant and a Dental Hygienist. The assistant manages the front of the office; answering phones, verifying insurance coverage, scheduling appointments, and more. A hygienist is responsible for more patient care. An assistant will not go to college as long of a time nor will the education be as thorough as it is for a Dental Hygienist.

Duties in this career include taking impressions of teeth, take and develop x-rays, educating patients on proper mouth care, assist in procedures, sterilize equipment, filing, appointment scheduling, and other office tasks. Take new patient history, scrape plaque and tarter from teeth, apply fluoride treatments to teeth, give local anesthetics, remove sutures, make notes in charts, and make molds of patients teeth.

The potential to become a Dentist is high. You work side by side with the dentist all day, every day and you assist in procedures. The skills that you learn while assisting will eventually pay off if you want to go further and get your dentistry degree.

According to the United States Department of Labor, you can expect to make between $44,900 and $92,860 a year, with an average of $65,000 to start. This is a very successful career and one that you will enjoy. This is a base line to give you an idea of your potential. Be sure to consider the minimal when you are first starting out.

Contact your local dentist offices before you spend time and money in training for a new career to see if you can work with them for a short amount of time. You want to be sure that this career is right for you.

If you are interested in becoming a Dental Hygienist, you must first locate an accredited school that offers the course. You have several options to choose from here; online courses or local college. If you know of a dentist office that is hiring any position or if you already work for a office, you may be able to receive on-the-job-training from the dentist office and never have to go to college. Dentists tend to offer this service more because the hygienist can be trained the way that they need or want the help. Some dental offices specialize in assisting children while others help people of all ages.
